Tiverton Turnpike Road                                        (updated 24th Sept 2013)

This turnpike was created in 1758 as a town-centred trust covering a network of roads in east Devon adjoining the Somerset border. Its main responsibilities were (a) the main north/south route from Exeter to Bampton and Exmoor (b) The Post Road to Taunton from Cullompton to the county boundary (c) roads radiating from Tiverton to smaller communities in NE Devon. By an Act of 1813 the Trust created a significant new road along the Exe valley to replace the old highway from Exeter to Bampton.

In support allegation Mr John Heard said roads are ruinous and rocky condition and in parts so extremely narrow that 2 horses loaded cannot pass without great difficulty or danger

Petition from Crediton and Parish of Upton Helions, Shoboke and Thorverton

These parishes will be burdened with paying a toll, when they can have no benefit of travelling on TP road between parishes and Crediton town; parishioners of Crediton have laid out £150 within 3 years past in widening and repairing road – and it is now in good condition – almost as good as any turnpike in the kingdom; and as roads are to be repaired progressively from Tiverton they will have little benefit.

And it will be of great detriment to town of Crediton to make parishes bringing commodities to Crediton Market pay a toll when they can only travel a few yards on the TP road. Mr John Heard said the TP road is already widened at expense of the parishes – pray prevent trustees erecting gate or taking tolls within 2 miles of Crediton.

That the road from Borough Corner in Parish of Halberton thru Halberton thru Burnaford, W Bunnival’s Cross in Parish of Cullompton and Bradninch and also the road from Way Post or North East end of Lennard Moor in Parish of Burlescombe in road between Tiverton and White Ball thru Parish of Burlescomb, Halberton, Willand and Cullompton are in a ruinous condition and narrow; can revision be made for these roads in the bill.

Mr Ryder reported   Also a petition from Parish of Witheridge, Templeton, East Worlington Thelbridge, Westington, Chedon, Chawley, Lapford and Chulmleigh

A Member said these are very ruinous and carriages are frequently obliged to go many miles about and several parts are very boggy and narrow

Mr Thomas Norraway said he knew road from House known by sign of The Bottle in Calverley in road from Crusey House to top of hill beyond a brook of water at the west end of Templeton Hill, to the Smith’s shop there in the road from Tiverton to Witheridge and that the road in ruinous condition and narrow and 2 horses cannot pass each other.

To prove allegation Mr Robert Pullan laid before Committee the accounts of tolls received over 8 years – annual income is £732-14-2d.

Owed on credit of Act, £10,300. Could not be repaired unless continued

Further said the two new roads were narrow and ruinous; for convenience of passengers going from Bickley Wood Cross to Ford Village will be necessary to carry road to Dandiland.

Bickley bridge was repaired by inhabitants of Tiverton but very little used but since Act passed, by constant usage the bridge is become ruinous and is narrow; that broad wheel carriages cannot pass over with injuring it and bridge must be repaired and widened.

An Act for repairing and improving the Roads leading to and from Tiverton, in the County of Devon. [6th May 1811.]

Tiverton 1813

An Act for enlarging the Powers of an Act of His Present Majesty, for repairing Roads leading to and from Tiverton, in the County of Devon, and for making a new Road to communicate therewith (23rd March 1813)

the making, maintaining, and keeping in Repair a Turnpike Road from the Town of Tiverton, in the said County of Devon, to Bampton,, by way of Bolham and Cove, and from Chapman's Bridge, in the Parish of Bampton aforesaid, by way of Duval, Westbrooke and Wonham, into the Road near Exebridge Turnpike Gate leading towards Dulverton, and which Road passes or is intended to pass through or into the Parishes of Tiverton, Bampton and Morebath, in the said County of Devon ; and also a Turnpike Road from the Toll House, near Bickleigh Bridge, into the present Road from Tiverton to Exeter, between the Fourth and Fifth Mile Stones, and from the Bottom of Cobland Cross Hill in the Parish of Bickleigh, into the said Road from Tiverton to Exeter, near the Sixth Mile Stone, and from the Corner of the said Road near Moony Banks Lane, through the said Lane into the Exeter Turnpike Road near the Fifth Mile Stone, and from Stoke Bridge in the Parish of Stoke Cannon, to Mary Pole Head, and from thence to the City of . Exeter, and which last-mentioned Road passes, or is intended to pass, into or through the Parishes of Bickleigh, Silverton, Rew, Stoke Cannon, and Heavitree, all in the County of Devon, and the Parishes of Saint David and Saint Sidwell, in the County of the City of Exeter, will be of great Benefit and Convenience to the Inhabitants of the said several Parishes.

 

Tiverton & Wiveliscombe 1830

An Act for improving several Roads, and making certain new Roads, in the Counties of Devon and Somerset, leading to and from the Town of Tiverton; and for amending an Act of His present Majesty, for repairing several Roads leading from and through the Town of Wiveliscombe. [29th May 1830.]

 

Acts repealed and replaced by new Act; And whereas the making of certain Alterations or Diversions in the Line of certain Parts of the said Roads, and the making and maintaining in repair certain new Lines of Turnpike Road to communicate with other Parts of the said Roads, .will be of great Benefit and Convenience to the Inhabitants of the several Parishes through which such Alterations and new Roads will pass, and will also be of great public Utility, by opening a better Line of Communication between the Towns of Tiverton and Southmolton, by making a new Piece of Road from the present Turnpike Road at a certain Place near unto and West of Mr.James Edward Teale’s Cottage, between the Sixth and Seventh Mile Stones on Gibbet Moor, to the present Highway at a Place called Two Gates, and by making Turnpike the said Highway from thence, with certain Diversions thereof to a Field in the Occupation of John Mogford, in the Parish of Knowstone, and by making a new Piece of Road from thence into the Wiveliscombe and Southmolton Turnpike Road, near the Eighteenth Mile Post; and by opening a better Line of Communication between the Towns of Tiverton and Chawleigh, by making a new Piece of Road from the present Turnpike Road leading from Tiverton to Southmolton, to from or near the Five Mile Post, between Tiverton to Southmolton; into the Highway in the Parish of Templeton, and making Turnpike the said Highway, with certain Diversions thereof, to a Place called Noman’s Land, in the Parish of Witheridge and by opening a better Line of Communication from Tiverton; towards the new Turnpike Road leading from Barnstaple to Exeter by making a new Piece of Road commencing at or near Penny Park in Tiverton aforesaid, to Quirkhill, and from thence to the present Highway near Lower Lugsland, and making Turnpike the said Highway, with certain Diversions thereof, to the said Place called Noman’s Land, and by making Turnpike the Line of the present  Highway from the said Place called Noman’s Land, with certain Diversions thereof, to the Southmolton Turnpike Road at Labbot’s Cross, and by making Turnpike the present Highway leading from the Southmolton Turnpike Road at or near Chawleigh, with a Diversion thereof through Lands in the Parish of Chawleigh, to the Turnpike Road now being made, leading from Barnstaple to Exeter, and by making a new Piece of Road leading from near Labbot’s Cross,, partly along certain existing Highways, to the present Turnpike Road leading from Barnstaple to Exeter, at or near Dinniford; and by opening a better Line of Communication between Tiverton and Cullompton, by making a new Turnpike Road commencing at or near the Bottom of the Hill called Newtes Hill, and leading into and through a certain Close called Culver Park, or other Lands, Part of the Glebe of the Portion of the Rectory of Tidcombe in Tiverton aforesaid, and through a certain Close in the Possession of John Skinner, and then partly along certain existing Highways through Warnicombe, Drizzlecombe and Rawridge to Crossland Cross, and from thence by the present Highway and certain Diversions to Sweaton, and from Sweaton to the Turnpike Road leading from Cullompton to Willand, at or near a Close in the Occupation of John Gale; also by opening a better Line of Communication from Tiverton towards Honiton, by making a new Turnpike Road commencing at or near the Eastern End of the Village of Halberton in the present Turnpike Road there, and leading partly along certain Highways through Spratford Green, and thence to the Highway leading from Burn Rew, and thence to the village of Willand aforesaid, and thence on to Bradfield Factory, and. thence to Lower Kentsford, and thence to Kentisbeer Moor, and thence into the Turnpike Road leading from Cullompton to Honiton. at or near a Field in the Occupation of Stephen Pyne; and also by opening a better Line of Communication from Tiverton towards Wellington in the County of Somerset, by making a new Piece of Road commencing near Putson Barn, on the present Turnpike lead leading from Tiverton to Halberton, through Part of Gornhay Farm in the Parish of Tiverton aforesaid, to a certain Highway there, and by making Turnpike the said Highway, with certain Diversions thereof, to Beam Bridge in the Parish of Sandford Arundell in the County of Somerset, where it will unite with the Turnpike Road leading from Tiverton to Wellington.

 

Purposes of the Act; That this Act shall be put in execution, for and during the Term herein-after mentioned, for the Purpose of more effectually repairing, widening, altering-, diverting, and from Time to Time amending, improving, and keeping in repair the Roads leading from Lowman Bridge in the Town of Tiverton, through the several Parishes of Tiverton, Halberton, Butterleigh. There are 87 miles 7 furl 5.5 pl of road thru 31 parishes – all repaired by the trustees

The greater part of the road are stated to be in “very good repair” but some part cannot be said to be so – no part under indictment for want of repair.

 

There is railroad in progress of being made from Bristol to Exeter, which will pass within 5 or 6 miles of Tiverton. When effected, it will lessen the tolls at some of the gates, but in all probability, it will not be completed to Exeter for many years.

 

There is a debt of £5,920 borrowed for making a new turnpike road from “at or near Penny Park, in Tiverton, to Noman’s Land,” under the powers of the said Act, for which no mortgages have yet been made (except for £200) but it s intended when this road is completed to grant mortgages at the rate of £5 per cent.

Report to Secretary of State 1861

BPP (1861)  No. 8.—TIVERTON ROADS.

The local Act for these roads, of the 11th of George IV. cap. 97, repealed the previous Acts of the 51st and 53rd of George III., and granted a term of 31 years, which will not expire until the end of the session next after June 1861.

 

The principal objects of this application to Parliament are set forth in the resolution ' passed unanimously at a meeting of the Trustees on the 4th of September last, as follows :—

 That inasmuch as the revenues of this Trust are not sufficient to pay the interest  on the mortgage debt of this Trust and keep the roads in repair, and seeing the difficulties in which the Trust is placed by reason of the inadequacy of its funds, and  that a reduction of such interest which the Trustees apprehend a new Act would provide for, should be settled as soon as possible, and to set at rest a question which  has been raised as to the construction of the application clause of the existing Act of  this Trust, and inasmuch also as the term of the existing Act will expire at the end of the session of Parliament after 1861, it is expedient that application should be made to Parliament for an Act to repeal the present Act, and extend or renew the  term, and to settle the affairs and financial arrangements of the Trust, and place them  on a satisfactory footing.

 

The roads belonging to this Trust are nearly 88 miles in length, and comprise the following lines, as described in clause 9 of the new Bill:—

No portions of the above roads are in a town ; but the road No. 15 appears to be at a few miles distant from the other roads of the Trust.  On the several lines of road the number of toll-gates or bars and the number of toll-payments are as under ,

And, generally, the gates and bars on the road No. 1, and the Horsden gate on No. 2, and the gates and bars on the roads Nos. 3 and 4, and the Ashley Gate on No. 6, and the gates and bars on the several roads Nos. 7, 3, 9, 10, and 13, free each other. The rates of tolls collected are those allowed by the local Act. sections (6 and 7, except as follows:—The toll in section 7 on horses, &c, more than three drawing any waggon. &c. (except a timber carriage) are reduced from 6d, 7.5d, and 9d., to 4d., 5d, and 6d.  -a similar reduction is made on horses, &c., if more than three, drawing any cart, &c, with two wheels (except timber carriage); the toll on horses, &c., if more than three drawing any timber carriage upon three or four wheels, are reduced from 8d., 9.5d.t and 11d. to 6d., 7d., and 8d.; and a similar reduction is made on horses, &c- if more than three, drawing any timber carriage with two wheels.

The accounts show that the toll-income was greatly- reduced on the main roads in 1844 and subsequent years, and on the new line from 1845; and the clerk explains, that these reductions were caused by the opening; of the Bristol and Exeter Railway; that the line monopolised a great portion of the traffic; from 16 to 18 stage coaches passed over the Trust roads through Tiverton daily, but since its opening every coach has ceased to run ; the use of private carriages, especially from Tiverton to Exeter, has also greatly diminished. The funds have been aided by parish contributions since the year 1847 on the main line, and in 1859 on the new line. These sums are not paid voluntarily, but are received under orders of justices. The clerk says, " the applications in the last year were in fact contested by the parishes on the ground that the estimated receipts and expenditure for the year included an amount for arrears of interest; and in one division the parish surveyors succeeded in getting the justices to refuse the orders. The funds of the Trust have been expended on the main lines, in repairing the roads, with parish aid; salaries, of reduced amounts since 1848; law-charges; and interest of debt. On the new line of road the funds have been expended, in repairing the road; salary of surveyor; law charges; and interest of debt: and improvements (for a new toll-house, &c.) in 1844. The large law charges, in both accounts include the costs of preparing deeds-poll, &c.

 

It will be observed that in the accounts for the year 1846 the sum of £908, was transferred from the main road to the new road, under the following circumstance:-, as explained by the clerk :—" For 6 or 7 years after the new road was made the tolls arising therefrom had been let with certain of the tolls on the old roads, and in making up the Trust accounts for such years the rent was apportioned and carried to the credit of the respective accounts but doubts having at length arisen as to whether the amount so carried to the credit of the new road account was a fair proportion in regard to that road, a committee was appointed to investigate the matter, and report thereon- The committee so appointed accordingly fully investigated the Trust accounts, and found that the amount from time to time curried to the credit of the new road account was considerably less than it ought to have been, and finally reported as to the total sum which ought therefore to be carried to the credit of the new Western Road; and at a meeting of the Trustees held at the Guildhall in Tiverton, on the 14th September 1846, it was ordered that such amount should be paid by the old Trust to the new Trust."

 

In the accounts inserted in this report the amount of the Tiverton paving tolls collected in or around Tiverton, rented by the Trustees, and paid over to the town Commissioners, is altogether omitted.

The clerk states that creditors owning the sum of £29.150 of debt on the main road, and of £5,444 of debt on the new road—total amount £34,594 —have assented to the resolution of the 4th of September last for an application to obtain a new local Act.

Borough Corner Road (No 5.) UC Road from Borough Corner, in the Parish of Halberton, on the Old Exeter Road (No. 1) near Butterleigh, SW through Butterleigh to Buddeford Cross (Burnaford, otherwise Bunnivals Cross), in the Parishes of Cullompton and Bradninch. (about 2 miles)

Crediton Forches Road (No. 6 - d) From the Hoop and Ball, (Broad Lane) Tiverton, the A396 SW to Bickleigh Bridge Cross, then fork SW as A3072 through Cadbury, Stockley Pomeroy, Shobrooke, to Crediton Forches, above Crediton (about 12 miles) The original road went through Little Silver and not Stockley - assume this was the UC road from Stockley Cross to radon and then UC road through Shobroke to rejoin A3072)

Rackenford Road (No. 7 - e) UC road (was B3221), parallel to A361, from Wellbrooke Bridge, Tiverton, through Calverleigh, Loxbear, Stoodley, and Rackenford, to bridge over Sturcombe River at Creacombe (Cruwyshay House) to join the South Molton Turnpike (about 9 miles)

Templeton Hill Road (No 7a not there in 1861); UC road from the Blue Bottle in the Parish of Calverleigh to Templeton and to the Smith's Shop at the West End of Templeton Hill, beyond the Brook of Water on the A373 from Tiverton to Witheridge (maybe to Templeton Lane and Witheridge Moor Cross);

Worthey Bridge Road (No. 8 - f)  UC road SW from Cottey House, Tiverton. through Seven Crosses to Little Silver (was Worthey Bridge over River Dart) (about 2.5 miles)

Old Bampton Road (No.9 - g); UC road from the Bampton Inn, Tiverton, northwards through Chettiscombe and Van Post, over Bampton Down to Bathram Bridge in Bampton Town (about 7 miles)

Bickleigh Bridge Cross Road (No. 10) A396 from Bickley Bridge Cross, beside Bickley Bridge, over River Exe and turn south, past Jenny’s Portion to Kenson Hill jct north of Rewe, on the Exeter Road
